|
Current Status: |
6/3/2020 - REPORTED OUT, Senate Judiciary, (Seventh Hearing) |
|
Comments: |
The bill is so broadly written that it effectively ends the death penalty. Post-conviction relief provision allows everyone currently on death row to file for relief based on the assertion that they had one of the listed mental illnesses at the time of their crime. Concern about delegation to APA to define the listed mental illnesses. Remove post conviction relief, major depressive disorder, language about "rational judgment," and language about mental illness due "solely" to the effects of drug or alcohol abuse. Could prevent prosecution for a more serious offense like intimidation or intimidation of an attorney, victim, or witness. |
Current Status: |
11/10/2020 - BILL AMENDED, Senate Judiciary, (Second Hearing) |
|
Comments: |
In several places, the bill prohibits a person from acting "with malicious purpose or in bad faith." This creates a gray area between "purposefully" and "knowingly" that will be problematic for prosecutors to prove. Recommend that these portions be amended to prohibit the person from acting "knowingly and without privilege to do so."Â Also concern that the bill could inadvertently lower penalties by replacing the current offense of unauthorized use of a computer with the new offense of computer trespass and by creating the new offense of electronic data theft. The current offenses of unauthorized use of a computer and theft provide higher penalties as the value of the loss goes up. |

Current Status: |

Comments: |
Violation of separation of powers to allow executive branch to override sentencing decision of judicial branch. Undoes compromise from several years ago when agreed to maintain judicial veto for sentences of two years or less. Many offenders with sentences of two years or less have enough credit for time served that they are immediately eligible for transitional control by the time the judge decides that prison is necessary. Undermines the determination made at the local level that a prison sentence was appropriate. |
