The bill is so broadly written that it effectively ends the death penalty. Post-conviction relief provision allows everyone currently on death row to file for relief based on the assertion that they had one of the listed mental illnesses at the time of their crime. Concern about delegation to APA to define the listed mental illnesses. Remove post conviction relief, major depressive disorder, language about "rational judgment," and language about mental illness due "solely" to the effects of drug or alcohol abuse. Recommend that these portions be amended to prohibit the person from acting "knowingly and without privilege to do so."  Also concern that the bill could inadvertently lower penalties by replacing the current offense of unauthorized use of a computer with the new offense of computer trespass and by creating the new offense of electronic data theft. The current offenses of unauthorized use of a computer and theft provide higher penalties as the value of the loss goes up.
